Digital Contract Signing

Written by Josie

πŸ”’ Digital contract signing is available as a paid add-on. Reach out in-app for more details

Send contracts to parents for digital signature, track progress as they sign, and store a legally valid signed contract automatically, all without leaving Famly.

This article covers what happens once you've sent a contract for signing. To create the contract itself, see our Digital Contract Templates article.

Who Can Sign Contracts

Digital signing currently requires both parents to complete and sign the contract. For each child, both parents must:

  • Have a Famly login

  • Not be set as a limited-access parent

If a parent doesn't have access yet, set them up before sending the contract.

How the Signing Flow Works

πŸ”’ To sign a digital contract as a staff member, you'll need the Manage contracts permission

Once you send a contract for signing:

  • Both parents are notified by email, in-app notification, and a to-do on their home screen

  • Each parent completes the required information about themselves

  • The first parent completes any remaining information about the child

  • Both parents sign, either digitally or by typing their name

  • The nursery receives a confirmation email once both signatures are in

  • The nursery adds the final signature to make the contract legally valid

  • Everyone receives a copy of the completed contract

πŸ’‘ If one parent has started signing, the other must wait until the first parent has finished before they can begin

Tracking Progress

You can see the full status of every contract, including who has signed, who has viewed it, and who is still pending, in two places:

  • The contract details side panel on the child's profile

  • The Contracts overview at Home, then Documents and Contracts

This gives you a single view of which contracts are complete, which are waiting on a parent, and which need your final nursery signature.

When a Contract Becomes Legally Valid

A contract is only legally valid once:

  1. Both parents have signed

  2. The nursery has added the final signature

Until the nursery signs, the contract stays pending, even if both parents have already completed their parts.

Famly's digital signing uses Simple Electronic Signatures in accordance with eIDAS (EU Regulation 910/2014). Depending on the type of contract and your jurisdiction, these signatures can be legally valid for agreements between childcare providers and families. It is the responsibility of each provider to confirm that digital signatures meet the legal requirements in their region before use.

ℹ️ This feature is not suitable for staff employment contracts, which may have additional legal requirements in your jurisdiction
